These Terms of Service ("Terms") govern your access to and use of the RushMandarin web application (app.rushmandarin.com), browser extension, and website (rushmandarin.com) (collectively, the "Service"), operated by RushMandarin LLC ("RushMandarin," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.

2. Your Account

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to notify us promptly of any unauthorized use of your account.
• You may sign in using email and password or a third-party provider (such as Google). You are responsible for keeping your chosen sign-in method secure.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to the Service, other users' accounts, or our systems;
• Interfere with or disrupt the Service or its infrastructure;
• Reverse engineer, scrape, or copy the Service except as permitted by law;
• Use the Service to infringe the intellectual property or other rights of others;
• Resell, sublicense, or commercially exploit the Service without our permission.

We may suspend or terminate accounts that violate these Terms.

4. The Service and Learning Content

RushMandarin is a tool to help you learn Mandarin Chinese, including by interacting with third-party content (such as videos and texts) that you choose. RushMandarin does not own third-party content you access through the Service, and your use of such content is subject to the terms of the platforms and rights holders that provide it. You are responsible for ensuring your use of third-party content complies with applicable terms and law.

5. Your Content

You retain ownership of the data and content you create within the Service (such as saved words, notes, and learning progress). You grant us a limited license to store, process, and display that content solely to provide the Service to you.

6. Intellectual Property

The Service, including its software, design, text, graphics, and trademarks (excluding third-party content and your content), is owned by RushMandarin and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial language learning.

7. Subscriptions and Payments

RushMandarin is currently offered free of charge. If we introduce paid plans, the pricing, billing cycle, renewal, cancellation, and refund terms will be described at the point of purchase, and this section will be updated before any charges apply. We may change pricing with reasonable notice.

8. Third-Party Services

The Service integrates with third-party providers (such as Google for sign-in). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that learning outcomes will be achieved.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUSHMANDARIN AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases; sections that by their nature should survive (e.g., intellectual property, disclaimers, limitation of liability) will survive.

12. Changes to the Service and Terms

We may modify or discontinue the Service, and we may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date and, for material changes, provide reasonable notice. Continued use after changes take effect constitutes acceptance.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-laws rules. Any disputes arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Denver, Colorado, and you consent to the personal jurisdiction of those courts.
